Real Estate Mediation and Leasing in Montenegro is now regulated by the law

Law on Mediation in the Sale and Lease of Real Estate was adopted on 30 July 2025, and came into force on 13 August 2025. It is expected that such law should bring order and professionalize Montenegrin real estate sector that so far operated according to undefined rules.

This new legislation introduces clear legal standards such as: 

  • mandatory licensing of intermediaries;
  • professional exam requirement for agents;
  • establishment of a register of authorized real estate agencies;
  • mandatory professional liability insurance.

The law also introduces significant penalties for violating its provisions: a legal entity will be fined from EUR 4,000 to EUR 20,000 for a misdemeanor, if it performs mediation and is not registered in the register of authorized real estate agencies. For such misdemeanor, the entrepreneur will be fined in the amount of EUR 2,000 to EUR 6,000.

Agencies and entrepreneurs who perform the activity of mediation and leasing of real estate are obliged to harmonize their operations with this new law and submit a request for registration in the register of authorized real estate agencies within 12 months from the date of entry into force of this law i.e. till 13 August 2026 at the latest.It is highly expected this new law shall put an end to the gray area in real estate transactions.
